SMS Opt-In Workflow

How Metronis collects express consent before sending any text message to a customer.

Metronis uses an in-app mobile opt-in flow to collect prior express consent from recipients before any automated SMS message is sent. Consent is collected at the point of interaction — on the retail sales floor — by an authorized salesperson using the Metronis mobile application. No message is sent unless the recipient's consent has been explicitly confirmed.

Consent Disclosure & Checkbox

When a retail salesperson enters a customer's phone number and toggles on "Phone" delivery in the Metronis app, a Message Consent Required notice is displayed before the form can be submitted.

This notice includes:

  • A clear statement that the recipient must agree to receive an SMS summary
  • A link to the full Terms & Conditions (which includes SMS consent terms, message frequency, opt-out instructions, and privacy disclosures)
  • A required checkbox: "I confirm the recipient agrees to receive this message"

Consent Confirmed & Report Sent

After the salesperson checks the consent box, the application displays a green "Terms accepted for this number" confirmation badge. Only at this point is the "Submit" button enabled and the SMS report sent.

Once submitted, the recipient receives a single transactional SMS containing their personalized appliance energy cost-savings report. The message includes:

  • A summary of the appliance comparison data
  • Clear identification of the sender (Metronis)
  • Instructions to reply STOP to opt out at any time
  • Instructions to reply HELP for assistance

Terms & Conditions

1. Overview

These Terms and Conditions ("Terms") govern your use of the Metronis application and associated services ("Service") provided by Metronis™ ("Company", "we", "us"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. SMS / Text Message Consent

By providing a mobile phone number through the Metronis application and affirmatively consenting (e.g., by checking a consent box), the recipient expressly agrees to: (a) receive automated text messages from the Metronis system containing appliance cost-savings reports, and (b) have their contact information shared with and retained by the authorized retail partner for follow-up communications, including marketing (see Section 3.1). This consent is given freely and is not a condition of any purchase.

2.1 Nature of Messages

Messages sent through the Metronis system are transactional in nature. They contain appliance energy cost-savings reports generated at the request of an authorized retail salesperson on the recipient's behalf. These messages are not marketing or promotional in nature.

2.2 Message Frequency

Message frequency varies based on usage. Typically, a recipient will receive one (1) message per report request. The recipient will not receive recurring or subscription-based messages unless a new report is explicitly requested on their behalf.

2.3 Standard Rates Apply

Standard message and data rates from the recipient's wireless carrier may apply. Metronis is not responsible for any charges imposed by the recipient's carrier.

2.4 Opt-Out / Right to Revoke Consent

Recipients may revoke consent and opt out of receiving messages at any time by replying STOP to any message received from Metronis. Upon receipt of an opt-out request, Metronis will confirm the opt-out and cease sending messages to that number. Opting out will not affect any other aspect of the recipient's relationship with the retail store or Metronis.

2.6 Consent on Behalf of Others

The individual providing a phone number through the Metronis application represents and warrants that they have obtained the recipient's prior express consent to receive automated text messages at the provided number. The individual assumes responsibility for ensuring such consent has been obtained.

2.7 Compliance with Applicable Law

Metronis operates in compliance with applicable federal and state laws governing automated messaging, including but not limited to:

3. Data Collection & Privacy

We collect the following information when a report is generated and sent:

This data is stored securely using industry-standard encryption and access controls. It is used solely for delivering the requested report, improving the Service, and maintaining records of consent as required by law. We do not sell, rent, or share personal information with unaffiliated third parties for their own marketing purposes.

3.1 Sharing of Information with the Retail Partner

By providing your contact information (including name, phone number, and/or email address) through the Metronis application, you acknowledge and agree that this information will be shared with and retained by the authorized retail partner ("Retailer") whose salesperson initiated the report on your behalf. The Retailer may use your contact information for the following purposes:

Metronis is not responsible for how the Retailer uses, stores, or protects your contact information once it has been shared with them. The Retailer's use of your data is governed by the Retailer's own privacy policy and applicable law. If you have concerns about a Retailer's use of your information, you should contact the Retailer directly.

If you do not wish for your contact information to be retained by the Retailer, you should inform the salesperson at the time of your interaction or contact the Retailer to request removal from their records.

3.2 Data Retention

We retain personal data only for as long as necessary to fulfill the purposes described in these Terms, comply with legal obligations, and maintain records of consent. You may request deletion of your data from Metronis systems at any time by contacting us at [email protected]. Please note that deletion from Metronis systems does not affect data independently retained by the Retailer.

3.3 Data Security

We implement reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

4. Use of the Service

The Service is intended for use by authorized retail sales personnel to generate appliance energy-savings comparisons for customers. By using the Service, you agree not to:

Energy cost estimates and savings projections are approximate. They are based on publicly available appliance specifications, manufacturer-reported data, and average residential electricity rates. Actual savings may vary depending on individual usage patterns, local utility rates, appliance condition, installation, and other factors. Metronis makes no guarantee that projected savings will be realized.

6. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, METRONIS™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

7. Indemnification

You agree to indemnify and hold harmless Metronis™, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including the sending of messages without proper consent.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which the Company is headquartered, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

9. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the most recent changes were made. If we make material changes, we will provide notice through the Service or by other means. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
